Anti-Money Laundering Violations
In addition to conducting tax examinations, the IRS also takes the lead on behalf of the Department of Treasury in performing anti-money laundering examinations. Generally, those examinations are conducted of financial institutions, such as banks, casinos, and money services businesses but that term also includes travel agencies, dealers in precious metals and other businesses. Depending on the nature of the examination, it may culminate in IRS imposed penalties and/or a referral to the Financial Crimes Enforcement Network (“FinCEN”) for further investigation.
FinCEN then may take action, including imposing penalties, seeking an injunction, initiating a civil proceeding, and/or referring the matter for criminal investigation and prosecution.
